REQUIREMENTS:
Juris Doctorate, licensed and in good standing to practice law in the State of Ohio and be able to be admitted to practice in federal courts.

Preferred requirements: minimum of three (3) years’ practice experience, including litigation of criminal cases and admission to U.S. District Court, Northern District of Ohio and U.S. Supreme Court. The preferred candidate will also have an interest in death penalty litigation, including trial and appellate responsibilities.

RESPONSIBILITIES:

  • Appellate proceedings: litigate criminal cases upon appeal in state and federal appellate courts where the Prosecuting Attorney represents the State of Ohio.
  • Trial support: conduct research and provide information to trial prosecutors regarding issues of law that arise during the trial process; collaborate with trial prosecutors regarding suppression issues; support efforts in obtaining local and foreign material witness warrants.
  • Post-trial proceedings: represent the State in all post-conviction matters pending in the Court of Common Pleas and federal courts, including post-conviction petitions and motions, new trial motions, motions to vacate pleas, sexual predator classification issues, and applications for expungement.
  • Writ actions: represent the Prosecutor, local common pleas judges, and the Sheriff of Cuyahoga County in writ actions; prepare actions in mandamus, procedendo, and prohibition.
  • Search warrants: responsible for drafting and/or reviewing search warrants on a 24/7 basis.
  • Death penalty litigation: conduct research and participate in trials, direct appeals, and post-trial petitions in capital cases; responsible for monitoring cases in state and federal litigation.
  • Parole board: represent the State of Ohio and victims of crime before the Parole Board in hearings, clemency applications, and pardon applications.
  • Other: willing to conduct all other duties as assigned, delegated or required of Assistant Prosecuting Attorneys and/or prescribed by law.

EXPERIENCE AND SKILLS:

  • Experience in research, writing, and arguing in courts of appeal;
  • Possesses superior research and writing skills; requisite understanding of constitutional law and criminal procedure;
  • Available to meet and work outside the normal working hours for trial preparation to advise law enforcement, and to prepare and review search warrants for probable cause;
  • Able to perform all other duties assigned, delegated or required of the Assistant Prosecuting Attorney-Appeals Unit as well as those prescribed by law;
  • Possesses qualities of fairness, a strong work ethic, have the highest integrity, and must also maintain the confidentiality of law enforcement and investigatory records and other confidential information;
  • Must be able to conduct business in accordance with federal statutes and guidelines, the Ohio Revised Code, the Ohio Administrative Code, and the Code of Professional Conduct.
  • PREFERRED EXPERIENCE of a minimum of three (3) years criminal litigation practice as a prosecutor or practice experience before administrative bodies as well as admission to U.S. District Court, Northern District of Ohio and U.S. Supreme Court.
